§ 2-87. Deposit or bond required.

  • The public information officer or his/her agent may require the requestor make a deposit or post a bond in the following instances:

    (1)

    For the payment of anticipated personnel costs for making available for inspection public information that exists in paper records if the information is older than five (5) years or completely fills, or when assembled will completely fill, six (6) or more archival boxes and the public information officer or his/her agent estimates that more than five (5) hours will be required to make the public information available for inspection.

    (2)

    For the anticipated costs for the preparation of a copy of public information if the public information officer or his/her agent has provided the requestor with the written itemized statement under section 2-89 detailing the estimated charge for providing the copy and the charge for providing the copy of the public information specifically requested by the requestor is estimated by the city to exceed one hundred dollars ($100.00).

    (3)

    For payment of unpaid amounts owing to the city in relation to previous requests that the requestor has made under this chapter before preparing a copy of public information in response to a new request if those unpaid amounts exceed one hundred dollars ($100.00).

    A request for public information to which this section applies is considered to have been received by the city on the date the city received the deposit or bond for payment of anticipated costs or unpaid amounts under this section. If a requestor modifies a request in response to the deposit or bond requirement, the modified request is considered to be a separate request for purposes of this article and is considered received on the date the city receives the written modified request.
