§ 17.5-27. Authority of planning and zoning commission.

  • The planning and zoning commission is given the responsibility and authority to review plats for subdivision, amended plats, resubdivision, and vacated plats. All land within the city or its ETJ hereafter subdivided into lots, blocks, or other parcels, shall be laid out subject to review by the planning and zoning commission. All other subdivisions or plats are illegal and shall not be recognized by the city. The review of all subdivisions shall be heard at a planning and zoning commission public meeting, unless otherwise stated in this chapter. The planning and zoning commission shall have full authority to give final approval for minor plats between five (5) and ten (10) lots. The planning and zoning commission shall forward all other plats to the city council with a recommendation to approve or disapprove the plat. A planning and zoning commission recommendation to the city council to disapprove a plat shall be accompanied with a written statement as to why approval of the plat should be denied.

    Amending plats and minor plats of four (4) or fewer lots fronting on an existing street and not requiring the creation of any new street or the extension of municipal facilities as defined in Section 212.0065, Local Government Code, V.T.C.A., shall be administratively approved by the city planner. In the event that a minor plat is submitted to the city planner, which the city planner does not approve, the city planner shall not disapprove the plat but shall refer the plat to the planning and zoning commission within the time period prescribed in Section 212.009, Local Government Code, V.T.C.A.
